About Hadayt Nazami
Hadayt is a senior lawyer with 20 years of litigation experience in complex Immigration and Refugee matters. He represents clients with all aspects of immigration and Refugee law. In his appellate practice before Federal Court and Supreme Court of Canada, Hadayt focuses on matters concerning national security, all other forms of inadmissibility, human rights and constitutional challenges under the Canadian Charter of Rights and Freedoms.
Some of Hadayt’s most notable cases include the recent landmark Supreme Court of Canada decision, Minister of Citizenship and Immigration v. Alexander Vavilov, 2019 SCC 65. Click here to read more. In this remarkable decision, the majority of the Court was persuaded to establish a new legal framework to determine the standard of review for administrative decision making – this is now known as the “Vavilov Framework.” To read an interview with Hadayt about this case please click here.
Hadayt also represented clients before the “Iacobucci Inquiry in Relation to Canadian Citizens Abdullah Almalki, Ahmad El Maati and Muayyed Nureddin” which brought to light the role that Canadian Intelligence and Security Agencies had played in the detention and torture of civilians in Syria and Egypt. In addition, Hadayt represented George Galloway, an anti-war British Member of Parliament, who was barred from Canada by the Immigration Minister (click here to read more), as well as numerous other state officials and celebrities.
Hadayt is also actively involved in law reform and advocacy. In 2016 and 2017 Hadayt represented Professor Felipe Montoya and his son, Nico, who was being barred from immigrating to Canada due to his diagnosis of Down Syndrome, as their political litigation Advisor. This action resulted in a significant change to the law and the abolishment of discrimination based on disabilities, which had been a apart of Canadian immigration law for many decades. The changes to the law are referred to by many as the “Nico amendment”. Click here to read more.
He has contributed much of his time and legal knowledge to communities of refugees trying to seek safety in Canada. Hadayt was instrumental in assisting Tamil refugee arriving to Canada by the boats, Sun Sea and Ocean Lady in 2009 and 2010. Click here to read more. His work drew attention to the unlawful detainment of Tamil refugees and helped them secure basic human rights.
Hadayt is a refugee himself and speaks several languages. Hadayt has been an advocate for social justice, equality and human rights all of his adult life. Hadayt received social justice award and international human right award while in law school.
